1. Introduction & Acceptance

These Terms of Use (“Terms”) govern your membership in the MegaShoppersDiscount savings program and your use of the megashoppersdiscount.com website (the “Site”). In these Terms, “MegaShoppersDiscount,” “we,” “us,” and “our” mean the operator of the MegaShoppersDiscount membership program; “you” and “member” mean the person who enrols in or uses the membership.

By enrolling in a MegaShoppersDiscount membership, or by using the Site or your membership benefits, you agree to these Terms. These Terms, together with any terms included in the materials provided to you at enrolment, make up the entire agreement for your membership. No other representations, promises, or verbal agreements apply. Please read them carefully.

2. The Membership & Savings Program

MegaShoppersDiscount is a paid membership club. As a paying member, you have access to the consumer benefits described in your membership materials and on the Site — including member pricing, rebate coupons, and cash back at participating stores, restaurants, and local businesses. Some benefits may not be available in your area, and we may add, change, or discontinue benefits without notice.

We are a membership club, not the retailer. MegaShoppersDiscount does not sell the products or services offered by participating merchants. All discounts, rebates, and offers are provided by third-party retailers and by our benefits partners; their availability and terms are set by them, not by us.

Membership benefits may be used only by you and your immediate family. “Immediate family” means the membership owner, their partner, and children living at the membership owner’s residence who are of legal age in their state. Benefits may not be resold. If your enrolment includes a free gift, you are limited to one gift per membership program, and depending on the gift you may be required to be an active paying member at the time your gift claim is processed. Members may also receive exclusive promotions on selected deals not listed on the main Site. For questions about membership privileges, contact Member Support.

3. Billing & Recurring Charges

By enrolling, you agree to become a paying member in return for access to the applicable consumer benefits. Your membership fee, billing frequency (monthly or annual), any introductory or trial terms, and your renewal price are the ones presented to you and that you agreed to at signup, and are shown on the offer page and in your order confirmation and billing statements. After any introductory or trial period, your membership automatically renews at your agreed rate until you cancel.

Card payments are processed by a PCI-DSS-compliant third-party payment processor.

4. Cancellation & Refunds

Cancellation. You may cancel at any time to avoid being charged your next fee. You can cancel through the cancellation page on this Site (megashoppersdiscount.com/cancel), by calling Member Support toll-free at 1-844-302-5913, or by emailing [email protected]. Cancellation instructions and your next billing date are also in the welcome letter or email you received at enrolment. We reserve the right to terminate a membership at any time with notice by email or letter.

Refunds. Any new or active member who has been billed in error, whose charges were not authorized by the cardholder, or who did not agree to these membership terms will receive an unconditional refund. To request a refund, contact us by phone or email (toll-free 1-844-302-5913 or [email protected]) and allow our compliance department the time needed to review the recorded enrolment call for the membership. Please allow up to 30 days for processing and for the credit to appear on your bank or credit card statement.

5. Eligibility

Membership is available only to individuals who are of the age of majority in their state of residence and who reside in the United States. The membership program is intended for U.S. residents and is not directed to individuals under the age of majority.

6. Acceptable Use & Member Conduct

You agree to use the Site and your membership only for lawful purposes and in accordance with these Terms. You will not misuse the Site, resell or share benefits outside your immediate family, attempt to gain unauthorized access to member accounts or our systems, interfere with the operation of the Site, or use the Site or benefits in any fraudulent or unlawful way. You are responsible for keeping your login credentials confidential and for activity under your account.

7. Intellectual Property

All content on the Site — including text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations — is the property of the Site’s owner, its content suppliers, or third parties, and is protected by United States and international copyright laws. All software used on the Site is the property of the Site’s owner or its software suppliers and is protected by the same laws. Retailer names, trademarks, logos, and designs are the sole property of their respective retailers, are shown as examples only, and remain protected by trademark and copyright law. MegaShoppersDiscount is not an agent or representative of, and is not affiliated with, those retailers.

8. Third-Party Merchants & Offers

Discounts, rebates, cash back, and other offers are made available by third-party merchants and by our benefits partners. MegaShoppersDiscount does not provide the underlying products or services and is not a party to your transactions with those merchants. Offer availability, pricing, and terms are set by the merchant or benefits provider and may change or end at any time. We do not guarantee any specific saving, offer, or result, or the quality of any merchant’s goods or services.

9. Disclaimers & Limitation of Liability

The Site and the membership benefits are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free, or that any particular offer or saving will be available. To the fullest extent permitted by law, MegaShoppersDiscount and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Site, the membership, or any third-party offer. Our total liability for any claim relating to the membership will not exceed the total fees you paid in the 12 months before the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold harmless MegaShoppersDiscount and its owners, officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site or benefits, your violation of these Terms, or your violation of any law or the rights of a third party.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Vermont and applicable U.S. federal law, without regard to conflict-of-laws rules. You and MegaShoppersDiscount agree that any dispute arising out of or relating to these Terms or your membership will be resolved in the courts located in Vermont, and you consent to their jurisdiction.

12. Arbitration & Class-Action Waiver

Please read this section carefully — it affects how disputes between you and MegaShoppersDiscount are resolved.

Binding arbitration. Except as provided below, you and MegaShoppersDiscount agree that any dispute, claim, or controversy arising out of or relating to these Terms, your membership, or the benefits will be resolved by final and binding individual arbitration, rather than in court. The arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules then in effect. The arbitrator, and not any court, decides all issues relating to the scope, interpretation, and enforceability of this arbitration provision.

Class-action waiver. You and MegaShoppersDiscount each agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

Small-claims carve-out. Instead of arbitration, either party may bring an individual claim in a small-claims court if the claim qualifies for that court and stays there.

30-day opt-out. You may opt out of this Arbitration & Class-Action Waiver section by sending written notice to [email protected] within 30 days of your enrollment. Your notice must include your name and the email address or account associated with your membership. If you opt out, disputes will be resolved in the courts identified in the Governing Law section above. Opting out has no effect on any other part of these Terms.

13. Changes to These Terms

MegaShoppersDiscount reserves the right to change these Terms at its discretion. Changes will be posted on this page with an updated “last updated” date. Your continued membership or use of the Site after changes are posted means you accept the updated Terms.
